Common Cause Indiana v. Indiana Secretary of State

Indiana law provides that the Democratic and Republican parties each nominates exactly half the number of Superior Court judges placed on the general election ballot.  This challenge by Common Cause Indiana charges that this election scheme unconstitutionally deprives general election voters of their First Amendment right to cast a meaningful vote.  In September 2013, the U.S. District Court for the Southern District of Indiana denied defendants’ motion to dismiss the lawsuit.
