Analysis by Richard Briffault: NY Public Financing Commission Has Legal Authority Over Campaign Contribution Limits

Legal experts sent Briffault’s analysis to commissioners on Sept. 27

In his analysis, Columbia professor and legislation expert Richard Briffault answers one of the New York public financing commissioners’ recurring questions during recent hearings: Does the commission have the authority to recommend reducing campaign contribution limits for all candidates, not just those who choose to participate in public financing? Briffault’s answer: Yes.

On Sept. 27, four legal experts sent Briffault’s analysis to the commissioners with a letter underlining its importance: Fritz Schwarz, Chief Counsel of the Brennan Center and former Chair of the New York City Campaign Finance Board; James Gardner, Professor at the University at Buffalo School of Law; Jerry H. Goldfeder, Special Counsel at Stroock & Stroock & Lavan LLP and former Chair of the Election Law Committee of the American Bar Association; and Peter L. Zimroth, Director of the Center on Civil Justice at NYU School of Law and former New York City Corporation Counsel.
