The Brennan Center is working in and out of court to protect our system of checks and balances and defend constitutional rights.

The Trump administration is undermining our democracy with aggressive assertions of executive power that violate the Constitution and federal laws. Many of these actions are compromising the federal government’s ability to provide the basic services that keep the country safe and prosperous. They are also undercutting individual rights and civil liberties. 

These actions have targeted the other branches of government as well. For example, the president has overstepped congressional limits on the use of force at home and abroad. The administration has usurped Congress’s power to appropriate federal funds. The administration has also threatened the judiciary’s authority to check presidential overreach.

The Brennan Center is fighting back. We file and coordinate friend-of-the-court briefs to support legal challenges, marshaling the expertise of our experts and other key voices nationwide. We shine a light on the many ways the administration’s overreach is violating the law and degrading Americans’ safety and quality of life. And we lay the foundations for a renewed vision of executive power that is compatible with the nation’s commitment to democracy and individual rights.
