  • State of California v. Trump

    On May 20, 2025, the Brennan Center for Justice filed an amicus brief in support of the plaintiffs’ motion for a preliminary injunction and opposing the government’s motion to transfer the case to the United States Court of International Trade on the grounds that the International Emergency Economic Powers Act does not authorize the president to impose tariffs.

  • Learning Resources v. Trump

    The Brennan Center filed briefs in several cases challenging President Trump’s unilateral imposition of global tariffs under the International Emergency Economic Powers Act.

  • Emily Ley Paper v. Trump 

    On May 12, 2025, the Brennan Center for Justice filed an amicus brief in Emily Ley Paper et al., v. Trump, opposing the government’s motion to transfer the case to the United States Court of International Trade on the grounds that the International Emergency Economics Powers Act does not authorize the president to impose tariffs. 

  • Arizona Free Enterprise Club v. Fontes

    Representing a bipartisan group of nine current and former election officials, the Brennan Center filed a friend-of-the-court brief in Arizona defending the state’s pro-voter policies for verifying absentee ballot signatures.

  • Mi Familia Vota v. Fontes

    The Ninth Circuit Appeals Court affirmed, among other things that Arizonans who do not provide proof of citizenship may continue to vote in all federal elections.. The Brennan Center and co-counsel, representing civic engagement and military support organizations, had filed an amicus brief urging the court to uphold 140 years of legal precedent and constitutional history that confirms Congress may regulate all federal elections, including presidential elections.
