The Brennan Center and co-counsel filed a federal lawsuit on behalf of cities and counties to challenge the Department of Homeland Security’s demand that states change election rules or lose antiterrorism funds. 

The Brennan Center for Justice has filed a lawsuit against the Department of Justice to compel compliance with a FOIA request seeking records on the DOJ’s attempts to gather, analyze, and use state voter registration lists.

Louisiana sued the Election Assistance Commission to change the federal voter registration form to add unlawful and burdensome requirements for proving citizenship. The Brennan Center and co-counsel filed a motion to intervene on behalf of voting rights organizations to protect access to the ballot box for eligible voters in Louisiana and beyond.

On March 31, 2026, President Trump issued an Executive Order purporting to unilaterally impose nationwide changes to mail voting. He has no authority to do so. On behalf of voting rights groups, the Brennan Center and co-counsel sued to challenge the order. 

The Brennan Center, along with co-counsel Robins Kaplan, filed an amicus brief arguing that state courts should decline to align their state constitutional protections with the U.S. Supreme Court’s interpretation of the federal Constitution.

The Brennan Center, along with the ACLU and ACLU-NM, filed an amicus brief asking the New Mexico Supreme Court to adopt a state-first approach to support the development of state constitutional rights. 

The Florida Supreme Court will hear oral argument on February 4 in a case examining the validity of Gov. Ron DeSantis’s politicized prosecution of confused or misled voters with past felony convictions.

The Brennan Center, along with the ACLU and ACLU-NM, filed an amicus brief asking the New Mexico Supreme Court to adopt a state-first approach in constitutional cases.

The Brennan Center asked the Michigan Supreme Court to clarify that state courts have a duty to provide state remedies for state constitutional violations committed by local officials.

The Justice Department sued the state board of elections over its voter rolls, putting the right to vote of hundreds of thousands of voters at risk. Individual voters and voting rights groups went to court to fight back.
