On Monday, the U.S. Supreme Court will hear arguments in a potentially pivotal case, McCrory v. Harris, dealing with whether North Carolina’s Republican lawmakers unconstitutionally packed African-American residents into two congressional districts when redrawing the state’s map, severely limiting African-American voters’ influence in selecting the state’s Congressional delegation.
In an op-ed this week, Brennan Center experts argued that the case presents the Court an important opportunity to assert its right to step in when normal political checks and balances have eroded to the degree where extreme gerrymandering is possible, as was the case in North Carolina. North Carolina Gov. Pat McCrory has argued in part that the districts were drawn to give Republicans a partisan advantage without consideration of race, a defense the lower court rejected.
