Buying Time 2012: West Virginia

West Virginia experienced a number of newsworthy judicial elections over the last decade, including in 2004, when a group called And for the Sake of the Kids spent more than $3 million to defeat an incumbent Justice, Warren McGraw, and to elect his challenger, Brent D. Benjamin. Spending in that election ultimately led to the landmark U.S. Supreme Court judicial recusal decision in Caperton v. Massey when Justice Benjamin later refused to recuse himself from a case involving the primary contributor to And for the Sake of the Kids.  The U.S. Supreme Court ruled that Justice Benjamin should have disqualified himself.

In 2012, two seats were in play—that of Chief Justice Robin Jean Davis, who was seeking re-election, and the seat previously held by Thomas McHugh, who did not seek re-election. Eight candidates competed in the May 8th primary, and two Republicans – Allen Loughry and John Yoder – and two Democrats – Letitia “Tish” Chafin and incumbent Justice Robin Jean Davis – faced off in the general election on November 6th for the two open seats. Of the four candidates, the two who received the highest number of votes would fill the two open positions.
