In recent years, the Supreme Court has repeatedly involved the concept of federalism as a justification for curtailing fundamental rights, limiting access to justice, and undermining progressive values. Through the Center’s It’s Not About Federalism initiative, we explore the underlying issues, such as union-busting, health care rights, and environmental concerns, that animate recent cases generally classified under the federalism rubric.
The Center sends periodic e-mails analyzing recent decisions that are “not about federalism”—i.e., cases that deal broadly with federalism issues, but are in fact motivated by other interests and forces.
