A man who the government claims fought “on the front line” of terrorism is given a door to freedom: Australian Guantánamo detainee David Hicks has entered a plea deal before one of the military commissions created by the Military Commissions Act, and agreed to serve nine months with immediate transfer to Australia.

Habeas Corpus Can’t Wait
Last week, the Court of Appeals for the District of Columbia acted to return Guantánamo detainees to the Supreme Court. They ruled against the detainees , holding that they have no rights under the Constitution, thanks to the Military Commission Act of 2006.

Justice Perverted
A federal appeals court ruled Tuesday that Guantnamo detainees no longer have a right to be heard in court. Unless this decision is rectified by the Supreme Court or by Congress, Guantnamo will once again become a legal black hole. Meanwhile, nearly 400 individuals remain imprisoned without due process.

The first twenty prisoners arrived in hoods and shackles. American officials placed them in cages, surrounded by barbed wire, at Camp X-Ray at the US Naval Base at Guantánamo Bay. That was five years ago. More than 700 people have been detained at Guantánamo since.

American Justice on the Line
Last week, a district judge in Washington dismissed the case of Guantanamo Bay detainee Salim Hamdan. In June, Hamdan won a landmark Supreme Court decision striking down President’s jerry-rigged system of military trials at Guantanamo. Now, thanks to a new law stampeded through Congress in October, Hamdan cannot even get into court. This decision should alarm all Americans who care about their country’s most basic rights and values.
