LSC-funded Southern Alleghenys Legal Aid Inc. (Pa.) attorney Mary E. Schellhammer represents Alphonso Andrews, the father of a four-year-old child whose mother gave her up for adoption without Andrews’ consent. Andrews has been working, with Schellhammer’s help, to gain custody of his daughter, known as Baby M, since she was 30 days old and he learned the child’s mother had agreed to the termination of her parental rights. The Pennsylvania Supreme Court decided in Andrews’ favor after four years of court battles, stating that because Andrews had objected to Baby M’s foster care placement, her prospective adoptive parents lacked in loco parentis standing and thus did not have parental rights over Baby M.
